Gold IPTV operates under the Digital Millennium Copyright Act, 17 U.S.C. § 512. Three procedures are set out below: how a rights holder sends a takedown notice, how someone affected by a takedown challenges it, and what happens to accounts that attract notices repeatedly.
1. Designated Agent
A Designated Agent receives copyright notifications on our behalf. Send anything DMCA-related there rather than to general support, or it will be slower reaching the right desk.
Email: help@goldiptvs.net
Subject: DMCA Takedown Notice — [brief description of the material]
Using that subject line is what routes the message straight to the copyright desk.
2. What a Takedown Notice Must Contain
If you hold rights in material you believe is being infringed on or through the Service, write to the Designated Agent. The statute prescribes what a notice has to contain, and all six elements below are required before it can be acted on:
- The work concerned. Identify the copyrighted work you say has been infringed. Where one notice covers many works, a representative list is acceptable.
- The material complained of. Identify what is infringing and where it sits, precisely enough for us to find it — specific URLs are best.
- How to reach you. Full name, postal address, telephone number and email address.
- A good faith statement that the use complained of is not authorised by the rights holder, its agent, or the law.
- A statement of accuracy, under penalty of perjury, confirming the notice is accurate and that you are the rights holder or are authorised to act for them.
- A signature, physical or electronic, of a person authorised to act for the rights holder.
A notice missing any of the six may be set aside as invalid, so it is worth checking before sending. Taking legal advice first is sensible: a DMCA notice is a sworn statement, not a complaint form.
3. What We Do With It
On receiving a complete and valid notice we:
- review it for validity and completeness;
- remove or disable access to the material where the Act requires it;
- notify the account holder responsible, where there is one;
- pass them a copy of the notice, so they can counter-notify if they believe it is mistaken.
4. Counter-Notification
If your material was removed and you believe that was a mistake or a misidentification, the remedy is a counter-notification to the Designated Agent at help@goldiptvs.net. It must contain:
- your full name, postal address, telephone number and email address;
- identification of what was removed and where it appeared beforehand;
- a statement, under penalty of perjury, that you believe in good faith it was removed through mistake or misidentification;
- your consent to the jurisdiction of the federal district court for the district you live in — or, if you are outside the United States, the district of New York;
- your agreement to accept service of process from whoever sent the original notice.
A valid counter-notification is forwarded to the original complainant, and the material may be restored in 10 to 14 business days unless they tell us they have gone to court to restrain the activity.
5. Repeat Infringers
Where the circumstances warrant it, accounts belonging to repeat infringers are closed. That judgement rests with us and is exercised in line with applicable law.
6. Misrepresentation
Under § 512(f), knowingly misrepresenting that material is infringing — or that it was removed by mistake — can make you liable for damages, including costs and legal fees incurred by the other side.
That cuts both ways, and we treat it seriously in both directions. Check every statement in a notice or a counter-notification before signing it.
7. Our Position
We act in good faith when processing notices and counter-notifications. We are not liable for removing material we reasonably believed to be infringing on the strength of a valid notice, nor for restoring material following a valid counter-notification.
8. Changes
This policy applies from the moment it appears here and may be revised without advance notice, with changes effective on posting. Worth re-reading occasionally if you rely on it.
9. The Rest of the Legal Set
